By accessing and using InstaInker ("the Service"), owned and operated by AIVN Tech Private Limited ("we," "us," or "the Company"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use this service.

2. Description of Service

InstaInker is a LinkedIn content generation and publishing platform that helps users create professional content using artificial intelligence. The Service provides AI-powered content generation, writing style analysis, topic suggestions, and direct publishing to LinkedIn.

3. User Accounts and Registration

To access certain features of the Service, you must register for an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Intellectual Property Rights

Your Content: You retain all rights and ownership of the content that you generate using our service. We claim no ownership over the text, images, or other media created by you on our platform.

Our IP: The InstaInker platform, logo, and underlying software are the property of AIVN Tech Private Limited.

5. LinkedIn Integration

InstaInker integrates with LinkedIn through official APIs. By connecting your LinkedIn account, you grant us permission to:

• Access your LinkedIn profile information
• Publish content on your behalf when explicitly requested
• Analyze your existing posts for writing style (if opted in)

You can revoke these permissions at any time through your LinkedIn account settings or by disconnecting the integration in InstaInker.

6. User Responsibilities

You agree not to use the service to generate content that is:

• Illegal, harmful, or threatening
• Defamatory or obscene
• Infringing on the intellectual property rights of others
• Misleading, false, or deceptive
• Spam or unsolicited marketing content

7. Subscription and Billing

Certain features of InstaInker require a paid subscription. Payment processing is handled by Dodo Payments, who acts as the Merchant of Record for all subscription transactions.

• You agree to pay all fees associated with your chosen subscription plan
• Subscription fees are billed in advance on a monthly or annual basis
• You may cancel your subscription at any time through your account settings
• Upon cancellation, you will retain access to paid features until the end of your current billing period

9. Limitation of Liability

To the maximum extent permitted by law, AIVN Tech Private Limited and InstaInker shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

10. Indemnification

You agree to indemnify and hold harmless AIVN Tech Private Limited, its directors, employees, partners, agents, suppliers, and affiliates from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

11. Service Availability

InstaInker is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted service and may modify, suspend, or discontinue the Service at any time with or without notice.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal proceedings arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal, India.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated to users through the Service or via email. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Either party may terminate this agreement at any time. Upon termination, your right to use the Service ceases immediately.
